I think the above logic falls considerably short.

Reporting to eBay is the proper think to do. Otherwise, the seller who
practices fee avoidance can have a nice advantage over other sellers who
follow the rules.

The wording is so vague as to be legally unenforcable.
Even eBay knows it since they state "Violations of this policy may
result in a range of actions". Whenever you see the word "may", think
idle blather (you should know all about that, I'm sure).
